Employee Free Choice Act (EFCA)
 - This is pending legislation which will amend the National Labor Relations Act and make it easier for employees to form, join or assist labor organizations. It has three primary components which includes:

  (1) Card check recognition requiring unions to present only a simple majority of authorization
       cards in order to represent a targeted bargaining unit; 

  (2) Interest arbitration if a first contract is not reached after 120 days of bargaining and
       mediation; and 

  (3) Enhanced penalties for unfair labor practices committed during organizing campaigns and
       first-contract bargaining.
 
This legislation represents very significant and very unfavorable changes to the NLRA for employers and employees.  You need to be proactive and be prepared. Good human resources management practices, an open door policy, effective communication, a competitive total compensation package and training are the keys to a productive work environment. Illinois Minimum Wage Increase -  Illinois Minimum Wage Increase is scheduled to be increased to $8.00 on July 1, 2009. The current rate is $7.75 which took effect July 1, 2008. Illinois law guarantees this minimum wage for workers 18 years of age and older.  Employers must post notices outlining the Illinois minimum wage requirements. The notices must be posted conspicuously and in enough places so employees can see them as they enter and exit the workplace. Posters are available from the Illinois Department of Labor, Wage and Hour Division website or you can call (800) 478-3998.
